How long does a typical sub-sale transaction take in Penang?
Most sub-sale transactions complete within three to four months from SPA execution, assuming the title is individual freehold and no state authority consent is needed. Leasehold or Bumiputera-reserved titles may add six to ten weeks for consent processing. We give you a specific estimate once we have reviewed the title document.
What are the typical fees involved in buying a property?
Fees depend on purchase price and loan amount. Stamp duty on the Memorandum of Transfer follows a tiered scale under the Stamp Act 1949. Loan agreement stamp duty is 0.5% of the facility amount. Legal fees for both SPA and loan documentation are based on the Solicitors' Remuneration Order 2023. We prepare a full cost estimate, including Land Office and registration charges, so there are no surprises.
Can Warisan Chambers act for me if the property is outside Penang?
We are able to handle matters for properties in Peninsular Malaysia, including Kuala Lumpur, Selangor, Kedah, and Perak. Each state has its own Land Office procedures and, in some cases, different state-level requirements for foreign buyers or leasehold consents. We will advise you of any state-specific steps before engagement.
What is the difference between a deed of assignment and an MOT?
A Memorandum of Transfer (MOT Form 14A) is used once an individual or strata title has been issued — it transfers legal ownership at the Land Office. A deed of assignment is used for properties without individual title yet (common in developer purchases under master title), where the purchaser's interest is documented and registered via the assignment instrument. We explain which applies to your specific transaction and why.
Do I need a separate solicitor for my bank loan?
In many Malaysian transactions, the same firm can act for both the sale and loan documentation, which simplifies coordination. Some lenders appoint their own panel solicitors for the loan agreement — we will confirm at the outset whether your financier permits our appointment and advise accordingly.
What should I bring to an initial consultation?
For a first meeting, it helps to have the property's lot or title number, any draft offer letter or LOA from your bank, and a copy of the existing title document if you have access to it. If the transaction is already at Letter of Offer stage, bring that as well. We can work with partial information and identify what else is needed once we have a clearer picture.
