These Terms and Conditions govern your use of the Warisan Chambers website and describe the basis on which we provide conveyancing and related legal services. Please read them carefully. By using this website or engaging our services, you confirm that you have read and accept these terms. If any part is unclear, you are welcome to write or call us before proceeding.

1. About Warisan Chambers

Warisan Chambers is a law firm practising property conveyancing in Malaysia, duly admitted and regulated under the Legal Profession Act 1976. Our principal office is located at Level 5, Wisma Penang Garden, 42 Jalan Sultan Ahmad Shah, 10050 George Town, Pulau Pinang. References in these terms to "we", "us", or "our" are references to Warisan Chambers.

We are members in good standing of the Malaysian Bar Council and hold professional indemnity insurance in respect of our legal practice.

4. Client Engagement

4.1 Letter of Engagement

Our services are provided on the basis of a written Letter of Engagement, which sets out the scope of the retainer, fee estimate, our obligations, and yours. No work will be undertaken until a signed Letter of Engagement is received and any agreed initial payment has been made.

4.2 Know-Your-Client Requirements

Under applicable anti-money laundering legislation and Bar Council guidelines, we are required to verify the identity of all clients. You will be asked to produce a valid identity document and supporting documentation before the engagement commences. We may also be required to obtain information on the source of funds in certain transactions. We appreciate your cooperation with these regulatory requirements.

4.3 Representation

We act solely in the interest of the client named in the Letter of Engagement. Where a transaction involves multiple parties, each party should be independently advised. We will inform you promptly if a conflict or potential conflict arises.

5. Fees and Disbursements

5.1 Professional Fees

Our professional fees are calculated in accordance with the Solicitors' Remuneration Order 2023 and applicable subsidiary legislation. Indicative starting fees are stated on our website for transparency; the final fee applicable to your matter will be confirmed in the Letter of Engagement.

5.2 Disbursements

Disbursements — including stamp duty, land search fees, registration fees, consent application fees, and courier charges — are payable by the client in addition to professional fees. We will provide a disbursements estimate before incurring any material third-party cost, and we will account to you for all sums received and paid out on your behalf.

5.3 Billing and Payment

We will render interim bills or requests for funds on account as appropriate to the stage of each matter. Payment terms are set out in the Letter of Engagement. We retain a solicitor's lien over documents and proceeds in the event of an outstanding balance.

5.4 Taxes

Our fees are stated exclusive of any applicable service tax or other government-imposed charges, which will be added where legally required.

Where incomplete or delayed instructions cause loss or prejudice to a transaction, we will not be responsible for any resulting consequences.

7. Confidentiality

All information you share with us in connection with a matter is held in strict confidence, in accordance with our professional obligations under the Legal Profession Act 1976, the Bar Council's Code of Ethics, and the Personal Data Protection Act 2010. We will not disclose your information to any third party except as required to carry out your instructions, as required by law or a court of competent jurisdiction, or as authorised by you in writing.

This obligation of confidentiality continues after the conclusion or termination of any engagement.

8. Conflicts of Interest

We carry out a conflicts check before accepting any new matter. If at any point during an engagement we identify an actual or potential conflict of interest, we will notify you promptly and discuss how to proceed. In the event of an irresolvable conflict, we may be required to decline or discontinue representation, in which case we will assist in transitioning the file to alternative counsel with minimal disruption to your matter.

9. Limitation of Liability

Our liability to any client for any loss or damage arising from or in connection with the provision of legal services is limited to the amount recoverable under our professional indemnity insurance policy. We are not liable for any indirect, consequential, or economic loss arising from your use of, or reliance on, general information published on this website in the absence of a formal engagement.

Nothing in these terms limits our liability for fraud, wilful misconduct, or any other liability that cannot be excluded under Malaysian law.

10. Intellectual Property

All content on this website — including text, layout, graphics, and firm documentation — is the intellectual property of Warisan Chambers unless otherwise stated. You may view, print, and share content from this website for personal, non-commercial purposes, provided attribution is given. You may not reproduce, republish, or adapt any content for commercial purposes without our prior written consent.

Legal documents, draft agreements, and written advice prepared in the course of an engagement remain our intellectual property until all outstanding fees are settled in full.

13. Termination of Engagement

13.1 By the Client

You may terminate our engagement at any time by written notice. We will render a final bill for work completed and disbursements incurred to the date of termination. Files and documents will be released to you or your nominated solicitors once all outstanding fees are settled.

13.2 By Warisan Chambers

We may terminate the engagement if you fail to provide instructions, fail to meet payment obligations, provide information that is materially false or misleading, or if continued representation would breach our professional obligations. We will give reasonable notice and assist in an orderly transition of your matter wherever possible.

14. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of Malaysia. Any dispute arising in connection with these terms or any engagement shall be subject to the exclusive jurisdiction of the courts of Malaysia. Where a dispute relates to professional conduct, the applicable disciplinary processes of the Malaysian Bar Council shall also apply.

15. Amendments

We may update these Terms and Conditions from time to time to reflect changes in our practice, regulatory requirements, or applicable law. The revised terms will be posted on this page with an updated effective date. For ongoing engagements, material amendments to the terms of the retainer will be communicated directly to you and will not take effect without your acknowledgement.
